Disciplinary Dilemmas
During an interactive Virtual Conference we asked the question, “Is it possible to discipline employees and NOT have them leave?” Attendees discussed three questions, and one tricky situation: Scenario: Your top salesperson (who is also the CEO’s brother-in-law) ignores the dress code, smokes in the office (which is…

What is considered a reasonable amount of time to use the bathroom each individual trip? Is 20 minutes considered unreasonable and as an employer is it considered discrimination or a violation of labor laws to place a time limit on the length of each bathroom visit?

Paint accumulation as a VSQG
Our facility is considered a VSQG. We have a small room that we keep our waste in until it is ready for pick up. We’ve been using that room to also store half empty gallons of paint, so it can dry out and we can just throw them in the trash. Is there anything wrong with doing that? We can accumulate quite a bit of paint at…

Are drivers required to utilize the 34hr reset?
I'm seeing drivers having issues with running out of hours just a few hours from home. In the "old days" (ie, pre-ELD) drivers would regain hours after their layover which would allow them to drive as many hours the next day as they did 8 days prior. While the reset option is ideal for regional or local drivers, long-haul…

HOS as applied to on call technicians
it would seem to me that no on call service could possibly fit into the HOS regulations. If I work from 7:00am to 5:30pm, I cannot drive after 9:00. Say I get a call at 1:30am the following morning, I can’t start working until 10 hours after I clocked out, so I can’t drive until 3:30am. Then if I take that call, I cannot…
