Dash cam live streams

We've been getting several questions about live stream dash cams and monitoring drivers. Is it possible to live stream a dashcam feed to monitor a driver in a commercial motor vehicle? Does anyone have experience with this?

  • A commercial truck is a public place, so the general use of dash cams to record video is not prohibited for recording in-cab or when road-facing. Without consulting an attorney, we cannot confirm if live-streaming video only is illegal without consent in specific states.

    If the driver operates in an all-party consent state, recording or listening in on conversations is illegal unless everyone involved gives their consent, including an enforcement officer during a stop. For example, it is a felony in Pennsylvania to record audio without consent.

     

    If the dashcam system can live stream video while driving (not when parked), you would want the driver's consent to avoid the impression of spying.

     

    •        If parked, a driver with a sleeper cab should be assured there is no ability to live stream except in an extreme emergency.

    Also, you cannot record videos on private property in many states. Military installations, locations with proprietary technology, and other entities may prohibit dashcam use during pickup or delivery. 

  • I've been seeing quite a few drivers doing live stream social media feeds while they drive CMV's. I'm a bit alarmed at the number of drivers that are actively responding to viewer comments while driving. It seems like live streams are in a gray area that isn't covered yet by most companies social media policies.


    Anyone tackled this issue?
