Is an employee required to follow an employer’s normal call-in procedures when taking FMLA leave?

  • When requesting leave employees must provide 30 days advance notice of the need to take FMLA when the need is foreseeable. When 30 days' notice is not possible, the employee must provide notice as soon as practicable and generally must comply with an employer's normal call-in procedures.

  • Employees taking approved consecutive FM Leave do not have to provide daily notice of absence. HR should stay in contact with them on a periodic basis to determine return to work status which is provided via a release to full duty from the treating physician (if the leave was employee medical).

    Employees approved for intermittent FM leave should provide notification per your policy of an absence due to FM related reason.
